This Privacy Policy describes Our policies and procedures on the collection, use and disclosure of Your information when You use the Service and tells You about Your privacy rights and how the law protects You.
We use Your Personal data to provide and improve the Service. By using the Service, You agree to the collection and use of information in accordance with this Privacy Policy.
About our Service
We provide the Service to our Customers under an agreement with them and solely for their benefit and the benefit of their personnel and other personnel authorized by them as users of the Service “Authorized Users.” Our Customers can efficiently store and analyze all their data in the Service. Because the Service can be accessed via mobile application or through a SaaS platform, Authorized users may access and use the Service from all over the world, subject to our agreement with our Customers and any applicable laws in effect at the time of disclosure of information.
This Notice does not apply to content that our Customers and their Authorized Users upload and, therefore, store, within the Service. In those situations, that Personal Data shall be processed by us on behalf of our Customer. Our Customer is therefore responsible for the collection and use of Your information and the Customer’s privacy notice, and not this Privacy Notice, shall apply to the Customer’s collection and use of that Your information. Therefore, in the event that you may have a concern or question with regards to Your information, in that situation, please contact our Customer as the Customer’s agreement with us governs our processing of Your Personal Data in that situation.
Interpretation and Definitions
Interpretation
The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.
Definitions
For the purposes of this Privacy Policy:
- Account means a unique account created for You to access our Service or parts of our Service.
- Affiliate means an entity that controls, is controlled by or is under common control with a party, where “control” means ownership of 50% or more of the shares, equity interest or other securities entitled to vote for election of directors or other managing authority.
- Application means the software program provided by the Company downloaded by You on any electronic device, which shall have one of our Customer’s names or reference to the Customer.
- Company (referred to as either “the Company”, “We”, “Us” or “Our” in this Agreement) refers to Automata Transactions LLC (d/b/a Grubbrr).
- Country refers to the United States
- Customer(s) means the client or clients of Ours that has a contract with us and has purchased the Application for which You are utilizing the Services.
- Device means any device that can access the Service such as a computer, a cellphone or a digital tablet.
- Personal Data is any information that relates to an identified or identifiable individual.
- Service refers to the Application.
- Service Provider means any natural or legal person who processes the data on behalf of the Company. It refers to third-party companies or individuals employed by the Company to facilitate the Service, to provide the Service on behalf of the Company, to perform services related to the Service or to assist the Company in analyzing how the Service is used.
- Usage Data refers to data collected automatically, either generated by the use of the Service or from the Service infrastructure itself (for example, the duration of a page visit).
- You (referred to as either “You”, “Your” or “data subject”) means the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.
Collecting and Using Your Personal Data

While using Our Service, We may ask You to provide Us with certain personally identifiable information that can be used to contact or identify You. Personally identifiable information may include, but is not limited to:

Usage Data is collected automatically when using the Service.
Usage Data may include information such as Your Device’s Internet Protocol address (e.g. IP address), browser type, browser version, the pages of our Service that You visit, technical information, or data obtained from API’s, the time and date of Your visit, the time spent on those pages, unique device identifiers and other diagnostic data.
When You access the Service by or through a mobile device, We may collect certain information automatically, including, but not limited to, the type of mobile device You use, Your mobile device unique ID, the IP address of Your mobile device, Your mobile operating system, the type of mobile Internet browser You use, unique device identifiers and other diagnostic data. We may also collect information that Your browser sends whenever You visit our Service or when You access the Service by or through a mobile device. Any Usage Data does not include the collection of Personal Data.
Information Collected while Using the Application
While using Our Application, in order to provide features of Our Application, We may collect, with Your prior permission:
- Information regarding your location
We use this information to provide features of Our Service, to improve and customize Our Service. The information may be uploaded to the Company’s servers and/or a Service Provider’s server or it may be simply stored on Your device.
You can enable or disable access to this information at any time, through Your Device settings.
Use of Your Personal Data
The Company may use Personal Data for the following purposes:
- To provide and maintain our Service, including to operate, audit and improve our Service through detection of bugs, reporting of errors, and performing activities to maintain the quality and safety of our Service.
- To manage Your Account: to manage Your registration as a user of the Service including the provision of products and Services that you request and the additional Customer service and support for those products and services.
- For the performance of a contract: the development, compliance and undertaking of the purchase contract for the products, items or services You have purchased or of any other contract with Us through the Service.
- To contact You: To contact You by email, telephone calls, SMS, or other equivalent forms of electronic communication, such as a mobile application’s push notifications regarding updates or informative communications related to the inquiries made by you, functionalities, products or contracted services, including the security updates, when necessary or reasonable for their implementation.
- Security: Enhance security, monitor, and verify identity or service access, combat fraud, spam, malware or other network and/or information security risks.
- To provide You with news, special offers and general information about other goods, services and events which we offer that are similar to those that you have already purchased or enquired about unless You have opted not to receive such information.
- To manage Your requests: To attend and manage Your requests to Us.
- Legal Protection: The Company may disclose Your Personal Data in the good faith belief that such action is necessary to:
- Protect and defend the rights or property of the Company
- Prevent or investigate possible wrongdoing in connection with the Service
- Protect the personal safety of Users of the Service or the public
- Protect against legal liability
- For other purposes: We may use Your information for other purposes, such as data analysis, identifying usage trends, determining the effectiveness of our promotional campaigns and to evaluate and improve our Service, products, services, marketing and your experience.
We may share Your Personal Data in the following situations:
- With Service Providers and Customer: We may share Your Personal Data with Service Providers and our Customers to monitor and analyze the use of our Service and to contact You.
- With Affiliates: We may share Your information with Our affiliates, in which case we will require those affiliates to honor this Privacy Policy. Affiliates include Our parent company and any other subsidiaries, joint venture partners or other companies that We control or that are under common control with Us.
- Business Transaction: If the Company is involved in a merger, acquisition or asset sale, Your Personal Data may be used, and subsequently, transferred. We will provide notice before Your Personal Data is transferred and becomes subject to a different Privacy Policy.
- With Your consent: We may disclose Your Personal Data for any other purpose with Your consent.
- Third Party Business Partners: Such as distributors, and/or referral partners, who are involved in providing services to our prospects and/or Customers, to answer and fulfill product and information requests and to provide potential Customers with information about Us and our products and Services. This only applies when You have purchased or specifically have stated an interest in an additional product or Service, and only then, may we share relevant Personal Data. Our Business Partners are solely responsible for managing their own use of Your Personal Data collected by them. Therefore, We disclaim, and you agree to relieve Us, from all liability from any Business Partner’s use of Your Personal Data under this Policy.
- Applicable Law: We may disclose your Personal Data to comply with lawful requests and legal process, to protect Our rights and property that our agents, Customers, members and others including to enforce our agreements, whether with a Customer or you, including agreements, policies, terms of use or in an emergency to protect the personal safety of any person.
Retention of Your Personal Data
The Company will retain Your Personal Data only for as long as is necessary for the purposes set out in this Privacy Policy. We will retain and use Your Personal Data to the extent necessary to comply with our legal obligations (for example, if we are required to retain your data to comply with applicable laws), resolve disputes, and enforce our legal agreements and policies.
The Company will also retain Usage Data for internal analysis purposes. Usage Data is generally retained for a shorter period of time, except when this data is used to strengthen the security or to improve the functionality of Our Service, or We are legally obligated to retain this data for longer time periods.
Transfer of Your Personal Data
Your information, including Personal Data, is processed at the Company’s operating offices and in any other places where the parties involved in the processing are located. It means that this information may be transferred to — and maintained on — computers located outside of Your state, province, country, or other governmental jurisdiction where the data protection laws may differ from those from Your jurisdiction.
Your consent to this Privacy Policy followed by Your submission of such information represents Your agreement to that transfer.
The Company will take all steps reasonably necessary to ensure that Your data is treated securely and in accordance with this Privacy Policy and no transfer of Your Personal Data will take place to an organization or a country unless there are adequate controls in place including the security of Your data and other Personal Data.
EEA and Switzerland Users: Legal basis for Processing Personal Data
If You are based in the European Economica Area (“EEA”), Automata Transactions LLC (d/b/a Grubbrr) is the data controller of Your Personal Data unless the data is being obtained by an affiliate, in which case, through the applicable training or local event, they collect, and therefore, control such Personal Data, which we will strive to make clear at the time of collection. The legal basis for this collection depends on the Personal Data concerned and the rational for the collection. Generally, this is done with consent, however, there are instances in which We may need to perform a contract, and therefore require this Personal Data, or where the processing is in our legitimate interests provided there are no data protection concerns or freedoms infringed upon. There are additional occasions where We have a legal obligation to collect Your Personal Data, and in that instance, whether to comply with legal requirements or to perform a contract, with you, We will notify you at that time.
International Data Transfers
Your Personal Data may be transferred to, and therefore processed in, countries other than the country in which you are a resident. Our website servers are located within the United States; however, we may process Your Personal Data in jurisdictions where our affiliates/partners and third-party service providers are located. A list of these is available upon request.
Our safeguards to your Personal Data remain the same whether in the United States or abroad, whether with Us or Our third-party service providers. Those safeguards including the implementation of the European Commission’s Standard Contractual Clauses for transfers of Personal Data between Us and our affiliates to whom we transfer the information which require these companies to protect Personal Data they process from the EEA or Switzerland in accordance with the applicable European Union Data Protection Laws in effect at the time of process. The Standard Contractual Clauses can be provided upon request.
Security of Your Personal Data
The security of Your Personal Data is important to Us, but remember that no method of transmission over the Internet, or method of electronic storage is 100% secure. While We strive to use commercially acceptable means to protect Your Personal Data, We cannot guarantee its absolute security. We take all reasonable and appropriate steps to protect your Personal Data in an effort to prevent loss, misuse, and unauthorized access, disclosure, alteration and destruction. Such measures may include, but are not limited to, physical access controls, encryption, firewalls, intrusion detection and network monitoring.
Opt Out Information
You always have the opportunity of opting out of any promotional emails from Us by either (a) following the instructions that are within each email or (b) emailing any changes to preferences or information to privacy@grubbrrstaging.mystagingwebsite.com. If You wish to utilize your consumer rights under the California Consumer Privacy Act (CCPA), please request a CCPA Consumer Rights Request Form or contact Us directly. The California Consumer Privacy Act of 2018 (“CCPA”), effective on January 1, 2020, requires that businesses, such as Ours, that collect Personal Data of California residents to make certain disclosures on how they collect, use, and disclose that Personal Data.
These requirements are addressed in this Section; however, this shall be in addition to the Privacy Policy as a whole.

We do not sell Personal Data as defined by the CCPA. The Personal Data, which is collected about you, and therefore shared with applicable third parties with whom We share that Personal Data for a business purpose is defined below:

Why We collect this Personal Data
We collect this Personal Data, identified above, to communicate with you, for marketing and promotional purposes, to develop, improve, and provide support to our Service. Additional reasons for collection can be found above in this Privacy Policy.
California Consumer Rights
You have the right to ask us to disclose certain information to you about our collection and use of your Personal Data over the past twelve (12) months. Once we receive and confirm your verifiable consumer request, we will disclose to you:

Deletion Request Rights
You have the right to submit a request by contacting us either at privacy@grubbrrstaging.mystagingwebsite.com or submitting a form, found here, that we delete any of your Personal Data that we collected from you and retained, subject to certain exceptions. Once we receive and confirm your verifiable consumer request, we will delete (and direct our service providers to delete) your Personal Data from our records, unless an exception applies. Each request must have Your first name, last name, email address, company and country/state and such information must match Our records prior to the fulfillment of any request.
We may deny your deletion request if retaining the information is necessary for us or our service providers to:
- Complete the transaction for which we collected the Personal Data, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform our contract with you.
- Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities.
- Debug products to identify and repair errors that impair existing intended functionality.
- Exercise free speech, ensure the right of another consumer to exercise their free speech rights, or exercise another right provided for by law.
- Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546).
- Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws (when the deletion of the information is likely to render impossible or seriously impair the research, if you previously provided informed consent).
- Enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us.
- Comply with a legal obligation.
- Make other internal and lawful uses of that information that are compatible with the context in which you provided it.
Data Protection in the EU or United Kingdom
If you are a “data subject” under applicable data protection law in the EU or United Kingdom, you will have the following rights in relation to personal data that we hold about you:
- Right to Access – to request confirmation of whether we process personal data relating to you, and if so, to request a copy of that personal data;
- Right to Rectification – to request that we rectify or update any personal data that is inaccurate, incomplete or outdated;
